Terms of Service

These Terms of Service ("Terms") govern your access to and use of Double Bagel, operated by Double Bagel LLC ("Double Bagel," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Double Bagel. These Terms apply to your use of Double Bagel as a player. Coaches on the platform are independent professionals bound by separate terms governing their relationship with Double Bagel. These Terms include a binding arbitration provision and class action waiver in Section 19. Please read carefully — they affect how disputes between you and Double Bagel are resolved.
1. The Service
Double Bagel is a marketplace that connects tennis players with independent coaches who provide tennis coaching services through video analysis and personalized feedback. The service includes:
- Free Shot Consults — short video analyses offered by participating coaches at no charge
- Single Lessons — full video coaching sessions priced and delivered by individual coaches
- Training Programs — multi-lesson packages designed by a coach around a player's game, with progress tracking
- Direct messaging between players and coaches
- Coach profiles, including profile-published content, reviews, and ratings
- Other features we may add over time
Coaches are independent professionals, not employees of Double Bagel. The underlying service they provide — expert tennis coaching — is a real-world human service delivered through video.
2. Eligibility and Account Holders
Geographic availability
Double Bagel is offered to players who are residents of the United States. Users outside the United States are not currently permitted to register as players. Users who access the service from outside the United States do so at their own initiative and are responsible for compliance with local laws.
Adults (18 and older)
Adults may create and manage their own Double Bagel accounts.
Minors (13 to 17)
Users between the ages of 13 and 17 may create their own accounts. At signup, you must affirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you confirm that this consent has been obtained. Parents and guardians are responsible for monitoring their minor's use of the Service. Alternatively, a parent or guardian may add the minor as a youth player profile under their own adult account.
Children under 13
Children under 13 may not create their own accounts on Double Bagel. Children under 13 may participate in the Service only as a "youth player profile" added by a parent or legal guardian to that parent's own adult account. The parent or guardian is the account holder of record and the contracting party under these Terms with respect to any youth player profile they add. Double Bagel does not direct content to children under 13, does not knowingly collect personal information from children under 13, and treats information provided by a parent about their child as information collected from the parent.
Parental consent for content involving minors
The parent or legal guardian managing a minor's account must provide consent for the player to upload video content showing the minor and to receive video lesson responses that may show or analyze the minor. By creating or maintaining an account for a minor, you affirm that you have provided this consent and that you have authority to provide it on the minor's behalf.
Lesson content involving a minor will not be used for any promotional purpose without separate, explicit, written consent from the parent or legal guardian.
General eligibility
By creating an account, you represent that the information you provide is accurate, that you (or, for accounts created on behalf of a minor, the parent or guardian) have the legal capacity to enter into these Terms, and that your use of the service complies with all applicable laws.
3. Accounts
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access.
You may sign up using email and password or via supported third-party authentication providers (currently Google; additional providers such as Apple may be added). Each person may maintain only one player account, except where a parent or legal guardian maintains an account on behalf of a minor child.
4. Coach Vetting
Before listing on the platform, each coach is reviewed by Double Bagel based on their stated tennis credentials, including playing experience, college tennis history, professional ranking, and coaching background. We verify these credentials through publicly available sources where possible.
Double Bagel does not conduct background checks on coaches. Coaches on the platform are independent contractors. Double Bagel makes no representations or warranties about any coach's background, character, qualifications, or fitness to work with players, including minors. Players and parents are solely responsible for their decisions to engage with any coach. Double Bagel is not liable for coach misconduct of any kind. Double Bagel reserves the right to terminate any coach's access to the platform at any time, for any reason or no reason.
5. Payments and Pricing
Coaches set their own prices for paid lessons within parameters established by the platform. Lesson prices are displayed on each coach's profile and at the point of booking. All prices are in U.S. dollars unless otherwise stated.
Payments are processed through Stripe. By making a payment, you agree to Stripe's terms and authorize Double Bagel to charge your payment method for the amount displayed at checkout. Payments for paid lessons are charged at the time of booking.
Because Double Bagel is a marketplace for real-world coaching services, payments on both our web platform and native mobile apps are processed directly through Stripe, not through the Apple App Store or Google Play Store billing systems.
Training Program auto-renewal
You may choose to enable auto-renewal for a Training Program. When auto-renewal is enabled:
- When you will be charged. No charge is made at the time you enable auto-renewal. Your payment method on file will be charged automatically when the final lesson of your current Training Program is delivered, at which point your next Training Program will begin.
- Amount of the charge. You will be charged the price displayed for your next Training Program at the time of renewal. Material changes to Training Program pricing will be communicated with reasonable advance notice and will not retroactively affect a renewal already in progress.
- How to cancel. You may turn off auto-renewal at any time before the final lesson of your current Training Program is delivered, with no charge or fee. To cancel, go to Account → Billing & Payments → Cancel auto-renew, or contact us at support@doublebagelapp.com. If you cancel before the final lesson is delivered, no charge for the next Training Program will be made, and your current Training Program will continue as scheduled through its final lesson.
- Confirmation. When you enable auto-renewal, you will receive a confirmation email restating the auto-renewal terms above and how to cancel.
6. Free Shot Consults
Free Shot Consults are short video analyses offered by participating coaches at no charge as a way to introduce their coaching. The following limits apply:
- Each player may receive at most one Free Shot Consult from any individual coach
- Each player may receive at most two Free Shot Consults across the entire platform during the lifetime of their account
Free Shot Consults do not require a credit card and are not eligible for refund since no payment is made.
7. Refund Policy and Satisfaction Guarantee
Training Program satisfaction guarantee
Players who purchase a 4-lesson program (package) may request a full refund of the package after receiving the first lesson, if dissatisfied. This satisfaction guarantee is limited to one refund per player. Additional refunds are at Double Bagel's sole discretion. To request a refund, contact support@doublebagelapp.com within 14 days of receiving the first lesson.
Single Lessons
Single Lessons are non-refundable once delivered. If the coach fails to deliver, see Section 8.
Service issues
If a coach goes unresponsive, fails to deliver a lesson within a reasonable time, or there is another genuine service problem, contact our support team. We may, at our discretion, reassign you to another coach, issue a full or partial refund, or take other appropriate action.
8. Platform Intervention
Double Bagel monitors coach performance and reserves the right to intervene if a coach becomes unresponsive, fails to deliver lessons, or otherwise falls short of platform standards. We may:
- Reassign your in-progress lesson to another coach
- Issue a refund for undelivered work
- Provide credit toward a future lesson
- Take other steps we determine appropriate to make the situation right
We are not, however, guarantors of any specific coach's individual performance and our liability is limited as described in Section 15.
9. Content Ownership and License
Your content
You retain ownership of the content you upload, including video uploads, messages, and other content you create or submit.
License to Double Bagel
By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and distribute your content as necessary to operate the service. This license is limited to operating the platform — delivering your video to your coach, displaying lessons to you, and similar core functions.
Coach lesson responses
Coaches retain ownership of the lesson content they create. As a player, you may view, download, and rewatch delivered lessons at any time, for personal use. You may not redistribute, repost publicly, or use coach lesson content for commercial purposes without the coach's permission.
Promotional use
Double Bagel may from time to time wish to use lesson content for promotional purposes — sharing clips on social media, featuring past lessons on a coach's profile, or showcasing the platform in marketing. We will not use any lesson content for promotional purposes without first obtaining the explicit written consent of the parties involved. Consent may be withheld without affecting your account. Promotional use of content involving minors requires explicit written consent from the parent or legal guardian.
Data retention and deletion
Double Bagel's data retention practices are described in our Privacy Policy, Section 5 (Data Retention). To request deletion of your account or specific data, contact support@doublebagelapp.com.
10. Reviews and Ratings
Players may leave reviews and ratings for coaches they have completed lessons with. When writing a review, you agree that:
- The review reflects your honest, firsthand experience
- You will not post false, misleading, or fabricated reviews
- You will not include personal attacks, discriminatory language, or content that violates our acceptable use standards
- You will not include confidential or personally identifying information about the coach
- You will not accept or offer compensation in exchange for positive or negative reviews
Double Bagel reserves the right to remove reviews that violate these guidelines or our Terms, and to suspend accounts that repeatedly violate them. We may also respond to reviews publicly to provide context or correct inaccurate information.
11. Acceptable Use
You agree not to:
- Use Double Bagel for any unlawful purpose or in violation of applicable laws
- Upload content that infringes the intellectual property rights of others, contains viruses, or violates the privacy of others
- Upload content that is obscene, abusive, harassing, threatening, or hateful
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorized access to other accounts, our systems, or user data
- Use automated tools (bots, scrapers) to access or extract data without our written permission
- Interfere with or disrupt the operation of the service
- Circumvent the platform to arrange coaching transactions outside of Double Bagel after meeting through the platform
- Solicit or accept off-platform arrangements with coaches you met through Double Bagel
12. Copyright and DMCA Policy
Double Bagel respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

(b) Takedown notice requirements
To be effective under 17 U.S.C. § 512(c)(3), a takedown notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it on the service (such as the URL or other specific location detail)
- Information reasonably sufficient to permit us to contact the complaining party (name, address, telephone number, and email address)
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate and that the complaining party is the copyright owner or is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
(c) Counter-notice procedure
If your content is removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice to our designated agent. To be effective, a counter-notice must include:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the Southern District of New York), and that you will accept service of process from the person who provided the original notification or an agent of such person
Upon receiving a valid counter-notice, we will forward it to the original complainant. We may restore the removed material in 10 to 14 business days following receipt of the counter-notice unless the original complainant first notifies us that they have filed an action seeking a court order to restrain the alleged infringement.
(d) Repeat infringer policy
Double Bagel will, in appropriate circumstances and in our sole discretion, terminate the accounts of users who are determined to be repeat infringers. A "repeat infringer" includes any user against whom two or more valid takedown notices have been received and processed, or who has otherwise demonstrated a pattern of infringement.
(e) False claims
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, the copyright owner or its authorized licensee, or by Double Bagel as a result of our reliance on the misrepresentation.
13. Feedback and Submissions
If you provide us with feedback, suggestions, feature ideas, or other input about Double Bagel ("Submissions"), you grant us a perpetual, worldwide, royalty-free, irrevocable, fully sublicensable license to use those Submissions for any purpose without compensation or credit. You waive any rights you may have to the Submissions and acknowledge that Double Bagel may already be developing similar ideas independently.
14. Service Modifications and Interruptions
We may modify, suspend, or discontinue any part of the service at any time — including for maintenance, updates, or improvements. Material changes affecting payment terms, refund policies, or core service functionality will be communicated with reasonable advance notice. We are not liable for service interruption, downtime, or loss of data resulting from such modifications. We will make reasonable efforts to minimize disruption.
15. Disclaimers
Double Bagel provides the service "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Double Bagel is a marketplace that connects players with independent coaches. We do not certify coaches as licensed instructors, do not control the content or quality of individual lessons or coach-published profile content, and do not guarantee specific outcomes from coaching. Tennis improvement depends on many factors including the player's effort, practice, and physical attributes. Results vary.
Coaches are independent professionals, not employees of Double Bagel. We do not guarantee the availability, expertise, or conduct of any individual coach beyond our credential review process described in Section 4.
16. Physical Activity Disclaimer
Tennis is a physical activity that carries inherent risks including injury. By using coaching content through Double Bagel, you acknowledge that you assume those risks. Consult with a physician before beginning any new exercise program. Double Bagel and our coaches are not responsible for injuries sustained during practice or play.
17. Limitation of Liability and Indemnification
Limitation of liability
To the maximum extent permitted by law, Double Bagel and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the service.
Our total liability to you for any claim is limited to the greater of (a) the amount you paid to Double Bagel in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Assumption of risk
Tennis is a physical activity. By using Double Bagel, you acknowledge that physical activity involves inherent risks, including risk of injury. You participate at your own risk. Double Bagel is not liable for any injuries, damages, or losses arising from following any coach's recommendations, advice, instructions, or training plans, whether delivered through the Service or otherwise.
Indemnification
You agree to defend, indemnify, and hold harmless Double Bagel and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service, (b) your violation of these Terms, (c) your violation of any third-party right, including intellectual property or privacy rights, or (d) any content you upload or submit to the platform.
18. Informal Dispute Resolution
Before filing any claim against Double Bagel, you agree to first attempt to resolve the dispute informally by contacting us at support@doublebagelapp.com with a written description of the dispute and your contact information. We will attempt to resolve the dispute through good-faith negotiation for at least 60 days from the date of your written notice. Neither party may file a claim, including arbitration, until this 60-day informal resolution period has elapsed.
19. Dispute Resolution and Arbitration
Binding arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of Double Bagel shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in New York, New York, or such other location as the parties may agree.
Class action waiver
You and Double Bagel agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class action or representative proceeding. The arbitrator may not consolidate claims and may not preside over any form of representative or class proceeding.
Exceptions
Either party may bring an individual action in small claims court for disputes within the scope of small claims jurisdiction. Either party may also seek injunctive or other equitable relief in court for matters relating to intellectual property infringement or unauthorized access to the service.
Opt-out
You may opt out of this arbitration agreement by sending written notice of your decision to support@doublebagelapp.com within 30 days of first accepting these Terms. Your opt-out notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.
20. Electronic Communications and Signatures
By using Double Bagel, you consent to receive communications from us electronically, including through the app, email, and push notifications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
You agree that your electronic acceptance of these Terms — including checking the "I agree to the Terms of Service and Privacy Policy" checkbox at signup — constitutes your legal signature and binds you to these Terms as if you had signed a paper copy.
21. Mobile Application Terms
Double Bagel is available as a web-based Progressive Web App and, where available, as native iOS and Android applications.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Double Bagel mobile application on a device you own or control, solely for your personal, non-commercial use. You may not: copy the app except as expressly permitted; modify, translate, adapt, or create derivative works based on the app; reverse engineer, disassemble, or decompile the app; rent, lease, lend, or transfer the app to any third party; or use the app in any way that violates these Terms or applicable law.
22. Apple App Store Terms
If you access Double Bagel through Apple's App Store, the following additional terms apply:
- These Terms are between you and Double Bagel only, and not with Apple Inc. Apple is not responsible for the app or its content
- Apple has no obligation to provide maintenance or support services for the app
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. Apple has no other warranty obligation with respect to the app
- Apple is not responsible for addressing any claims by you or any third party relating to the app or your use of the app, including product liability claims, consumer protection claims, or claims that the app fails to conform to any legal or regulatory requirement
- In the event of any third-party claim that the app or your use of the app infringes intellectual property rights, Double Bagel — not Apple — will be solely responsible for investigating and resolving the claim
- You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
23. Google Play Terms
If you access Double Bagel through Google Play, you agree to comply with Google Play's terms of service in addition to these Terms. Double Bagel's privacy practices are disclosed in our Privacy Policy and in the Google Play Data Safety form for the app.
24. Termination
You may close your account at any time through your account settings or by contacting support. Upon closure, your access to the service will end, though certain provisions of these Terms (including those relating to content licenses already granted, intellectual property, disclaimers, indemnification, and limitation of liability) will survive.
We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent or harmful conduct, or for any other reason we believe is necessary to protect Double Bagel, our users, or the public. Where reasonable, we will provide notice and an opportunity to cure before termination.
25. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Subject to Section 19 (arbitration), any judicial proceedings shall take place in the state or federal courts located in New York County, New York.
26. Changes to These Terms
We may update these Terms from time to time. Updates fall into two categories:
- Minor updates (typo fixes, clarifications, additions of new optional features) become effective upon posting. Your continued use of the service after such updates constitutes acceptance.
- Material updates (changes to payment terms, fee structure, refund policies, content rights, dispute resolution, or termination) require explicit re-acceptance. We will notify you by email or through the app, and you will be asked to accept the updated Terms before continuing to use the service.
If you do not agree to updated Terms, you must stop using the service and may close your account.
27. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Double Bagel regarding your use of the service as a player. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms may not be assigned by you without our prior written consent, but we may assign them without restriction.
